Court declares girl can sue school over janitor
BISMARCK, ND — The North Dakota Supreme Court has ruled that Washburn Public Schools (WPS) can be sued for allegedly not properly supervising a janitor after a parent complained about his conduct, according to The Jamestown Sun.
A 16-year-old WPS student allegedly complained to the school that the head custodian had made inappropriate advances and comments during his employment at the school, the article stated.
According to the article, the district ordered the custodian to stay away from the girl, but allegedly did not supervise him enough.
The Supreme Court reversed an earlier lower court decision not to award the girl a monetary claim, the article noted.
The reversal was on the grounds that claims she suffered were of a mental or psychological nature, not physical, the article added.
