Janitorial company pays hefty settlement for labor code dispute

SAN DIEGOTidy Building Services has agreed to pay the California labor commissioner''s office $100,000 in a settlement over allegations it did not provide enough money to subcontractors for required Social Security, disability and unemployment insurance payments, according to the San Diego Business Journal.

According to the story, the money will be used to reimburse approximately 200 janitors working for the company for back compensation, with payments ranging from $100 to $2,000.

The state labor code makes it illegal for business owners to subcontract services without providing enough funding to allow those workers to comply with all laws and regulations, the story stated.

The lawsuit, filed in 2008, was the state''s first attempt to enforce the law, which was created to address problems in industries where violations of wage and hour laws are more common due to the use of immigrant workers, the story noted.

Tidy Building Services is based out of New Orleans and has California locations in San Diego and Los Angeles, the story added.
