School officials charged in custodian’s misconduct case

ST. PAUL, MN — Two St. Paul Public Schools administrators are charged with failing to report a longtime custodian's suspected misconduct to police, despite an internal investigation and warnings from other staff members, according to the St. Paul Pioneer Press.

Beth Behnke and Craig Guidry, the former principal and assistant principal of Linwood Monroe Arts Plus, are each facing one misdemeanor count of “failure to report maltreatment of a minor” under the state's mandatory reporting law, the article stated.

According to the article, the "failure to report" charge against the administrators is related to a January 2012 police investigation of alleged incidents at the school around that time, none of which was reported by school officials to police.

"Mandated reporters are required to file reports within 24 hours of their direct observations or indirect information they receive. The responsibility to make such a report to the appropriate law enforcement agency or social services agency is not excused by the belief a mandated reporter may have that such a report will be filed by someone else in the organization's hierarchy," said Dakota County Attorney James Backstrom in a statement.
