SAN ANTONIO, TX — Two workers have filed a lawsuit against three companies, claiming they were neither paid for all the hours they worked, nor paid minimum wage or overtime as required by the state, according to the Seguin Gazette.
The lawsuit was filed against Caterpillar Inc., McLemore Building Maintenance Inc. and Texas Power Systems LLC, all of whom jointly employed the workers in 2010 and 2011, the article stated.
According to the article, the lawsuit states that the companies failed to record and pay them for all of their hours and required the workers to do unpaid work off the clock.
The plaintiffs, Filiberto Castaneda and Reymundo Ferrell Castaneda, argue that the three companies violated the federal Fair Labor Standards Act and that McLemore Building Maintenance Inc. in particular breached its contract with the workers, the article noted.
